Divorce Financial Settlement

A financial settlement decides how you and your ex divide everything you own. This includes property, savings, pensions and debts. You can reach one by agreement, through mediation, or by asking the court to decide. There’s no time limit on applying, so it’s worth getting right, even years after your divorce.

This is where we come in. Our McKenzie Friends at McKenzie Picave help you work through your financial settlement, so you understand what’s fair and what you’re entitled to.

Financial Settlement After Divorce

Many people assume finances are sorted the moment a divorce is finalised. They aren’t. A divorce ends the marriage. It doesn’t divide the money. Without a separate financial settlement, your finances can stay legally linked to your ex, sometimes for years.

This matters even if you think everything’s already been split. A verbal or informal agreement isn’t enforceable. If your ex’s circumstances change later, for example a pension grows or a business is sold, they may still have a claim.

We’ll help you sort your financial settlement properly, whether that’s before, during, or after your divorce is finalised. Then we’ll help you make it legally binding, so it can’t be reopened later.

Get In Touch to Discuss The Process

From the very beginning, Daniel demonstrated his expertise and knowledge of family law, providing invaluable guidance throughout the entire process. He took the time to understand my situation and priorities, ensuring that my voice was heard and my concerns were addressed.

Denisa Gabris

What stood out most to me was his understanding of family law procedure, his preparation, and his ability to remain calm and strategic under pressure. He consistently identified issues others missed, prepared excellent case summaries, bundles and position statements, and always ensured I fully understood what was happening at each stage of proceedings.

Usmaan Saleem

I feel very fortunate to have been introduced to McKenzie Picave. I have been through the family court for years. Spent an eye watering amount in the process. Not only did MP go above and beyond on numerous times. They are extremely well connected and live, eat, breath family law. Im genuinely in awe of their commitment to the betterment of families lives.

Mike Avey

Daniel represented me in Child and Financial matters during solicitor negotiations and latterly in court facing barristers, throughout the process he maintained a totally objective view giving many different scenarios and guiding me which route to follow. He was always available to be contacted and offered general support when I was having a bad day!

Why People Choose a McKenzie Friend

The benefits & meaning of a McKenzie Friend

The traditional route to a financial settlement often means two solicitors and sometimes two barristers. Every letter, call and meeting adds to the bill. Even simple disagreements can become expensive, fast.

McKenzie Picave takes a different approach. As award-winning McKenzie Friends, we help you understand your financial position clearly, so you can negotiate from a place of knowledge, not guesswork. We’ll tell you honestly what’s realistic and what isn’t. Even when that’s not what you want to hear.

Our goal is a fair settlement, reached without unnecessary conflict or cost. If your case needs more support than we can give, such as a complex contested dispute, we’ll say so, and help you find the right next step.

FAQs

We have provided answers to some of the most frequently asked questions about financial settlements. If you do have any further questions, never hesitate to get in touch with us.

Do I need a solicitor for a financial settlement?

No. You’re not required to use a solicitor. Many people reach an agreement with support from a McKenzie Friend or a mediator instead.

Is my divorce finalised without a financial settlement?

Yes, but your finances may still be legally linked to your ex. A separate financial settlement is needed to formally divide everything.

How long do I have to sort my financial settlement?

There’s no fixed time limit, but it’s best to sort this close to your divorce. Waiting can leave you exposed to claims later on.

What if my ex and I can't agree?

We’ll help you explore mediation first. If that doesn’t work, you may need to apply to the court for a decision.

How do I make my financial settlement legally binding?

Once you agree, it needs to be turned into a consent order. This makes it enforceable and prevents future claims.
